Reclaiming Handling Fees for Commercial Loans
+ The current state of opinion on commercial loans with agreed handling fees and its large relevance to economic practice.
+ When will a repayment claim’s period of limitation start?

Agenda:
In the light of the German Federal Court’s decision made on 4 July 2017 on commercial loans with standard contract terms on handling fees, we will start with identifying the cases where reclaiming handling fees could take place and point out when banks might be entitled to collect similar fees.

Next, we will be speaking about when a repayment claim’s period of limitation will have begun and, above all, if and how a right to claim repayment might be excised.
